US Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since his release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her decision, the court pointed out that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
Background of the Legal Challenge
The court proceedings involve conflicting assertions. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.
Conditions of Release
The judge, who was hearing his petition to deportation in a Maryland district court, determined that he must now comply with the conditions of his release from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
This decision marks a significant development in a complex legal case involving allegations of wrongful detention and contested criminal affiliations.
